These Terms apply to all workers including employees, casuals, subcontractors, and trial workers (“Worker(s)”) engaged by Sawan Property Services Pty Ltd (“the Company”), located in Sydney, NSW. These Terms outline the mutual responsibilities of all parties and operate in accordance with the Fair Work Act 2009, the Cleaning Services Award, and NSW law.
- Scope of Work: Workers may perform residential, commercial, end-of-lease, and post-construction cleaning. Workers must only perform tasks within their training and in compliance with NSW safety regulations. No maintenance, repair, strata, or building work is permitted.
- Updates to Terms: The Company may update these Terms when required. Employees will be notified, and any changes affecting employment conditions will only apply once the employee has confirmed written agreement. Subcontractors will be notified and may continue or cease work based on the updated Terms.
- Incident Reporting: Any incidents, unsafe conditions, or injuries must be reported to the Company within two (2) hours. This aligns with NSW Work Health and Safety obligations.
- Company Property: Company-issued equipment, materials, and uniforms must be used appropriately and returned in good condition. For employees, any deductions for loss or damage will only occur where lawful and with separate written consent. Subcontractors may be invoiced for loss or damage in accordance with their contract.
- Respectful Conduct: Workers must treat clients, their homes, and their premises with respect and professionalism. Inappropriate behaviour may result in immediate removal from site and further action.
- Handling of Client Property: Workers must not move, use, or access client belongings unless instructed by the Company or client. Unauthorised handling or removal is a serious breach of conduct.
- Timekeeping and Attendance: Workers must accurately record start and finish times. Deliberate misreporting or repeated lateness may result in disciplinary action or termination of engagement.
- Workplace Safety and Awareness: Workers must follow the Company’s safety procedures, report hazards immediately, and use appropriate PPE at all times.
- Resignation and Notice: Casual employees may resign at any time without notice under Australian law. Permanent employees must provide notice in accordance with the Cleaning Services Award. Subcontractors must provide seven (7) days’ written notice unless otherwise agreed.
- Behaviour at Client Sites: Workers must not smoke, eat, drink, or use client facilities without permission. Visitors are not permitted at job sites.
- Uniform and Identification: Workers must wear Company-issued uniforms and identification while on duty. Employees will not be required to pay for uniforms unless permitted by law.
- Confidentiality: All client information must remain confidential during and for six (6) months after engagement ends. Any breach may result in disciplinary or legal action.
- Work Standards: The Company may inspect completed work. If work does not meet required standards, workers may be asked to correct issues. Employees will be paid for all hours worked, including rectification. Subcontractors must rectify issues at their own cost unless otherwise agreed.
- Payments and Deductions: Employees will be paid in accordance with their classification under the Cleaning Services Award. Any deduction from wages (e.g., for equipment loss or overpayments) will only occur where lawful and with separate written consent. Subcontractors may be invoiced for damages or breaches according to their contract.
- No-Shows and Cancellations: Employees must provide at least four (4) hours’ notice if unable to attend a shift. Subcontractors must provide 24 hours’ notice. Failure to notify may result in disciplinary action, or for subcontractors, non-allocation of future work.
- Performance and Conduct Reviews: Repeated lateness, client complaints, or safety breaches may result in warnings, suspension, or termination under Fair Work procedures.
- Transport Responsibility: Workers must arrange their own transport to job sites and ensure punctual arrival.
- Phone and Social Media Use: Mobile phones may be used during breaks or emergencies only. Workers must not take photos or videos on client premises or post any client or Company information online.
- Exit Process: Company items must be returned in good condition upon ending engagement. Employees cannot have final pay withheld unlawfully; deductions require separate written consent. Subcontractors may be invoiced for unreturned or damaged items.
- Professional Responsibility: Workers must not engage in dishonest behaviour, falsify records, or act in a way that may damage the reputation of the Company. Such behaviour may result in termination and legal action.
- Dispute Resolution: Concerns should first be raised with the Company in writing. If unresolved, matters may be escalated to the Fair Work Commission, NSW Fair Trading, or other relevant authorities.
